1. Agreement to Terms

By engaging our swimming instruction services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. About Our Services

Learn to Swim - by Frank Romani provides professional swimming instruction services including:

• Individual swimming lessons for adults and children
• Group swimming lessons
• Baby swimming programs
• Aqua fitness classes
• Swimming technique improvement

3. Booking and Scheduling

3.1 Lesson Booking

• Lessons must be booked in advance through phone or email contact
• Booking confirmation will be provided via phone or email
• Lesson times are subject to instructor availability and pool accessibility
• We reserve the right to reschedule lessons due to unforeseen circumstances

3.2 Package Lessons

• Lesson packages must be used within 12 months of purchase
• Packages are non-transferable between different students
• Unused lessons in expired packages cannot be refunded

4. Payment Terms

4.1 Payment Methods

• Payment is due before or at the time of service
• We accept cash, bank transfer, and digital payments
• Package deals must be paid in full before the first lesson

4.2 Pricing

• Current pricing is displayed on our website
• Prices include VAT where applicable
• Prices may be subject to change with 30 days notice
• Existing packages purchased remain at the original price

4.3 Refunds

• Individual lessons can be refunded if cancelled with 24+ hours notice
• Package refunds will be calculated on a pro-rata basis for unused lessons
• No refunds for no-shows or same-day cancellations
• Refunds will be processed within 14 business days

5. Cancellation Policy

5.1 Student Cancellations

• 24+ hours notice: Full refund or lesson rescheduling available
• Less than 24 hours: 50% charge applies
• No-show: Full lesson fee applies
• Emergency cancellations: Considered on a case-by-case basis

5.2 Instructor Cancellations

• Lessons cancelled by instructor will be rescheduled at no charge
• If rescheduling is not possible, full refund will be provided
• Weather-related cancellations will be rescheduled when safe conditions return

6. Health and Safety

6.1 Health Declarations

• Students must disclose any relevant health conditions before lessons
• Medical clearance may be required for certain conditions
• Pregnancy, heart conditions, and recent surgeries must be disclosed
• Students swim at their own risk and physical capability

6.2 Safety Requirements

• Students must follow all pool safety rules and instructor directions
• Appropriate swimwear is required for all lessons
• Students under 16 must have parental consent and supervision arrangements
• Emergency contact information must be provided and kept current

6.3 Insurance and Certification

• Our instructor is fully certified and insured
• Students are advised to have their own health/travel insurance
• Pool facilities carry public liability insurance

7. Liability and Risk

7.1 Assumption of Risk

Swimming activities involve inherent risks. By participating in our lessons, you acknowledge and assume the risks associated with swimming and aquatic activities, including but not limited to:

• Risk of drowning or water-related injury
• Slipping or falling in pool areas
• Muscle strains or other physical injury
• Allergic reactions to pool chemicals

7.2 Limitation of Liability

• Our liability is limited to the maximum extent permitted by law
• We are not liable for personal property loss or damage
• Students participate at their own risk and responsibility
• Parents/guardians assume responsibility for minors

8. Conduct and Behavior

8.1 Expected Behavior

• Respectful behavior towards instructor and other students
• Following pool rules and safety guidelines
• Arriving on time and prepared for lessons
• Honest communication about abilities and concerns

8.2 Unacceptable Behavior

• Disruptive, aggressive, or disrespectful behavior
• Under the influence of alcohol or drugs
• Failure to follow safety instructions
• Inappropriate physical contact or behavior

8.3 Right to Refuse Service

We reserve the right to refuse service or terminate lessons for safety reasons, inappropriate behavior, or non-compliance with these terms. No refund will be provided in cases of service termination due to misconduct.

9. Privacy and Photography

• Personal information is handled according to our Privacy Policy
• Occasional photos/videos may be taken for progress tracking (with consent)
• Marketing use of images requires separate written consent
• Students may request deletion of their images at any time

10. Force Majeure

We are not liable for inability to provide services due to circumstances beyond our control, including but not limited to:

• Natural disasters or extreme weather
• Pool facility closures or maintenance
• Government restrictions or public health measures
• Instructor illness or emergency

11. Intellectual Property

• All teaching methods and materials are proprietary
• Students may not record or reproduce lesson content without permission
• Website content is protected by copyright

12. Governing Law

These terms are governed by the laws of Luxembourg. Any disputes will be resolved through Luxembourg courts or agreed alternative dispute resolution.

13. Changes to Terms

We may update these Terms of Service from time to time. Continued use of our services after changes constitutes acceptance of the new terms. Significant changes will be communicated to existing students.
